What To Do After An Accident

Your response immediately after an accident may prove crucial in preserving the evidence essential to any potential claim.  If possible, get the following information.  If you are conscious, but cannot do it yourself, then ask someone present to gather the information for you.

  • Get the name, address, telephone number, of the other driver

  • Get the driver’s license number

  • Get the insurance information of the other driver;

  • Look around immediately and identify any and all possible witnesses to the accident.  Ask for their names, addresses, any telephone numbers (home, cell, work) and where they work.  If they do not want to get involved, if possible, take down their car license plate number and State;

  • Listen carefully to what the other driver says about the events leading up to the accident, such as “I didn’t see you” and write it down, if possible;

  • Call the Police or have someone else call the Police immediately.  The Police Officer will generally interview all drivers and take witness statements from all witnesses that remain present.  The Police may also collect vital physical evidence and make important measurements useful in reconstructing the point of impact and vehicle speeds upon which the automobile driver’s liability will often turn;

  • You have a duty to be cooperative with your own insurance company.  However, you have no such duty to cooperate or give a recorded statement to the insurance company for the driver who caused the accident;

  • Follow through on all medical care, treatment, and therapy recommended by your physician;

  • Contact our office.  It is critical that you find a motorcycle accident attorney to represent you right from the start;

  • Do NOT get into an argument with the other driver about what happened;

  • Do NOT have your motorcycle repaired until you have spoken with an attorney who can have the motorcycle inspected, photographed, and provide the insurer, or defense attorney, an opportunity to inspect the motorcycle;
