After a Motorcycle Accident – What Should You Do?

There are situations in which a motorcycle rider has been injured in an accident that was caused by another driver, but the driver and the insurance company dispute that the driver was at fault.  It is crucial that you are represented by a skilled Denver motorcycle accident lawyer immediately after such an accident.  In order to assist motorcycle riders, a list of actions to take if you are involved in an accident has been provided for you.  If you follow these steps, it may save you from having to fight to prove you are not at fault, or you will at least have evidence to support your side of the case.

After an accident, if possible, take the following actions or get someone with you to do so:

  1. Get medical assistance for yourself or any other injured party.  These are often multiple vehicle accidents, and there may be other injured parties.
  1. Call law enforcement to come to the scene.  They will investigate the accident as well as take measurements and witness accounts, which can be very useful in your case.  It could be helpful to get the badge number of the law enforcement officer handling the case.  Answer their questions and treat them respectfully.
  1. Get the name, address and telephone number of the driver(s) involved in the accident, as well as their insurance information and driver’s license number, or have someone help you to do so.
  1. Try to get the names, addresses and phone numbers from any witnesses that saw the accident.
  1. Write down anything you hear the at-fault driver say at the scene if possible, for later use in your claim.
  1. You are required to contact your own insurance company and answer any questions they have for you.
  1. You are NOT required to respond to questions from the other insurance company adjuster or other personnel without first discussing it with your Denver motorcycle accident attorney.
  1. Get in touch with the Colorado Bikers Association to help you find a qualified and experienced motorcycle accident lawyer to protect your rights.
  1. If your doctor has recommended certain medical treatment or rehabilitation, it is important that you follow through with the treatments, and keep all documentation and medical bills in a safe place.
  1. Never argue or get in any altercations with the other driver.  Stay as calm as possible.
  1. Do not get the motorcycle repaired until the attorney has advised you to do so.  It is likely that this is part of the evidence that will be needed to make your claim for damages.  Usually the motorcycle will need to be photographed and examined by experts from both sides in any serious injury case.
  1. Do not have a conversation about the accident with any insurance adjuster or “friendly” individual from the other driver’s insurance company without first being advised by the Denver motorcycle accident attorney representing you in the case.

Denver Motorcycle Accident Lawyer

In many serious accident cases, the injured individual is unable to carry out any of these steps.  In these cases it is important to know that you should not speak to an insurance adjuster from the other driver’s company without first contacting our offices and getting connected with a motorcycle accident lawyer, even if you are in the hospital.  If necessary, an attorney could come to interview you at the location where you are getting medical treatment.  With legal representation, you will know how to proceed without saying or doing anything that could jeopardize your case in the future.  This is very true in cases where the injured individual is now on painkillers and hospitalized and can hardly be considered to be at their best.

Do not have the motorcycle repaired until the attorney advises you to do so.  Follow through with all the medical treatments that are advised by your physician.  Keep careful documentation of all the costs that are being incurred due to the injury, including costs to your family, whatever they may be.
